The 9th Circuit Court of Appeals had strong words for Oregon State University and its president Ed Ray.

Suppressing conservative campus papers and destroying their property violates the Constitution.

During the winter of 2008-2009, campus officials ordered the removal of distribution bins and copies of The Liberty, a conservative paper produced by Oregon State students and sponsored by the campus group OSU Students' Alliance.

According to the Yamhill Valley News Register, officials were enforcing an existing, but unwritten, policy restricting the placement of "off campus" publication bins.

The 9th Circuit agreed with the conservative group that The Liberty was an on campus publication.  It also said that it had "little trouble" finding constitutional problems with the university's decisions.

While its legal fight is not yet over, The Liberty did score a victory by convincing the usually liberal 9th Circuit to restore their case after it had been tossed by a lower court.

    • I read the whole decision, and am in a state of guarded optimism. The Ninth Circus Court of Appeals FINALLY sided with conservatism, dealing a blow to OSU. Hopefully, it will stick, and the bins be replaced.

    • Sorry, misunderstood your qutsieon. I don't really have a personal spreadsheet, but I have the data from the National Inventory reports (see EC Summary of Trends) on my machine so I can grab data if I need them for Canada. Country-to-country, I tend to look at prices as my definition for sandbagging, not any particular reduction measurement. If you are meeting a target with a price of 0, you are sandbagging your target.Happy election night!Andrew

    • I am a sophomore at Oregon State who will be interning with the NJC this summer, and I actually wrote an article on this recent court decision that was published by our campus newspaper, the Daily Barometer. I am appalled by our administration's close-mindedness and their impediment on a student's right to free speech and I wish more light would be brought to this situation on my campus. It seems to be flying surprisingly under the radar. The student body, faculty, and staff should be made aware of the lengths to which our administrators will go to rid the campus of a right-wing, conservative presence.
